Charter Rates

Charter rates are quoted in Euro. Rates include the following:

  • Hire of the yacht and its equipment (onboard entertainment equipment, auxiliary crafts, and water toys).
  • Crew wages.

What is Not Included in Charter Rates

Additional expenses incurred during the charter are not included. These expenses cover, but are not limited to:

  • Food and beverages for the charter guests
  • Fuel for the yacht, auxiliary crafts, and water toys
  • Berthing fees, harbor and pilot fees
  • Customs charges, divers' fees (if required)
  • Communication charges, guest laundry
  • Shore-side utilities (electricity and water)
  • Onshore transfers and tours
  • Taxes, VAT, and any other charges not specifically listed in the charter fee

Advance Provisioning Allowance (APA)

For crewed charters, the Charterer will prepay an estimated amount to cover these expenses. The Captain will manage and account for the APA during the charter, providing receipts and periodic updates on expenses. At the end of the charter, a breakdown of costs will be provided. The APA is collected as part of the final payment before the charter begins.

  • The APA typically ranges from 20% to 35% of the charter fee, depending on guest requirements and charter location.
  • Any unspent APA will be refunded to the Charterer.
  • If expenses exceed the APA amount, the Charterer must settle the difference in cash before disembarking.

VAT (Value Added Tax)

In accordance with Greek law, VAT is charged to the Charterer. The VAT amount may vary, and any changes in the tax laws will be passed on to the Charterer.

Availability and Rates:

  • Availability and rates vary depending on the charter season.
  • Embarkation and disembarkation times may vary depending on the specific dates. Please confirm these times with our team.

Additional Services:

  • Airport pickups, transfers, helicopter transfers, air charters tours, ticketing, hotel accommodations, car rentals, and currency exchange are not included in the charter price. We can arrange these services at an additional cost, which may be deducted from your Advance Provisioning Allowance (APA).

Special Conditions:

  • Smoking: Smoking is strictly prohibited inside the vessel.
  • Itineraries: All itineraries are suggested and subject to change based on weather and sea conditions. The Captain has the final authority to alter the itinerary for passenger safety and comfort.
  • Berthing: While we will make every effort to secure berths in the chosen ports, the Owner, Stakeholder, and Captain cannot be held responsible for final berth allocations.
  • Children: Children must be always supervised by an adult.
  • Personal watercraft: The use of personal watercraft is permitted only for operators who possess the necessary licenses and adhere to all local operating regulations. Any liability resulting from non-compliance with these requirements rests solely with the operator.
  • Payment: Any outstanding balance must be paid to the Captain in cash before disembarkation.
  • Advance Provisioning Allowance (APA): All amounts payable must be cleared in full to the owner’s account. Any deductions for bank expenses, credit card fees, or other reasons will be made from the APA.
  • Taxes: Any applicable taxes, including VAT, will be the responsibility of the Charterer. Any changes in tax legislation after the Charter Party is issued will be reflected in the final payment. Should any changes in applicable tax legislation take place after the issuance and signing of the Charter Party, resulting in changes in total amount(s) due, then the difference will be credited or debited accordingly to the Charterer. The sole condition for this adjustment is that the change in tax legislation must be proven to have occurred after the Charter Party's issuance and be applicable during the charter period.

Maximum Capacity and Passenger Health:

  • Maximum Capacity: The Charterer shall not exceed the maximum number of guests specified for sleeping or cruising on board. Additional visitors may be permitted at the Captain's discretion while the vessel is securely moored or anchored, or as allowed by local authorities.
  • Passenger Health: The Charterer warrants that all members of the Charterer's party are medically fit for the voyage. The Charterer and their party are responsible for obtaining necessary visas and vaccinations for the countries to be visited.

Crew:

  • Captain and Crew: The Owner we provide a qualified Captain and crew who meet all regulatory requirements. The crew will comply with all laws and regulations of the countries visited.
  • Crew Rest: The crew is entitled to adequate rest periods in accordance with international maritime labor standards.
  • Confidentiality: The Captain and crew will maintain the confidentiality of all information related to the charter, the Owner, the Charterer, and guests.

Captain's Authority and Responsibilities:

  • The Captain is responsible for the safe operation of the yacht and the well-being of all on board. The Captain has the authority to make decisions regarding the itinerary, anchoring, and other operational matters. The Charterer and guests must comply with the Captain's instructions at all times.
  • The Captain may restrict the use of water sports equipment if deemed necessary for safety reasons or due to irresponsible behavior.

Delays and Cancellations:

  • Delay in Delivery: If the yacht is delayed due to unforeseen circumstances, the Owner will either refund a portion of the charter fee or extend the charter period.
  • Failure to Deliver: If the yacht cannot be delivered within a reasonable timeframe due to unforeseen circumstances, the Charterer may cancel the charter and receive a full refund
  • Cancellation by Owner: If the Owner cancels the charter due to unforeseen circumstances, the Charterer will receive a full refund plus liquidated damages of an amount equivalent to 10 percent (10%) of the Charter Fee.
  • Cancellation by Charterer: If the Charterer cancels the charter, they may be liable for a cancellation fee.
  • Vessel Breakdown: If the yacht breaks down, the Owner will either repair the yacht or offer a refund or extension of the charter period. In severe cases, the Charterer may cancel the charter and receive a refund.

Use of the Vessel:

  • Compliance with Laws and Regulations: The Charterer and Guests must comply with all laws and regulations of the countries visited.
  • Pets and Animals: No pets or animals are allowed on board without the Owner's written consent.
  • Behavior: The Charterer and Guests must behave responsibly and avoid causing any disturbance or damage.
  • Commercial Activities: Commercial photography or filming is prohibited without the Owner's written permission.
  • Respect for Crew: The Charterer and Guests must treat the crew with respect.
  • Smoking: Smoking is restricted to designated outdoor areas.
  • Illegal Substances and Weapons: The possession or use of illegal drugs or weapons is strictly prohibited.
  • Assignment: The Charterer may not assign the charter or sublet the vessel without the Owner's written consent.

Security Deposit:

  • If applicable, a Security Deposit will be held by the Owner. This deposit may be used to cover any damage or liabilities incurred by the Charterer. If not required, as confirmed by the Captain, the deposit will be refunded to the Charterer after the end of the charter period or upon settlement of all outstanding matters.

Complaints:

  • If you have any complaints, please inform the Captain immediately. The Captain will notify the relevant parties and attempt to resolve the issue. If the issue cannot be resolved on board, please contact the Owner within 24 hours. Please provide a written description of the complaint as soon as possible.

Force Majeure:

  • Neither party shall be liable for any delay or failure to perform any obligation under this Charter Party due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, natural disasters, strikes, lockouts, industrial action, epidemics, pandemics, or government actions.  

Dispute Resolution:

  • Any dispute arising out of or in connection with this Charter Party shall be resolved amicably.

Arbitration and Law:

This Agreement shall be governed by and construed in accordance with English law and any dispute arising out of or in connection with this Agreement shall be referred to arbitration in London in accordance with the Arbitration Act 1996 or any statutory modification or re-enactment thereof. The arbitration shall be conducted in accordance with the London Maritime Arbitrators Association (LMAA) terms current at the time when the arbitration proceedings commenced.
